Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and the operators of ChainTok (“ChainTok,” “we,” “us,” or “our”), governing your access to and use of the ChainTok website (https://chaintok.com), mobile applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Overview of Services​

ChainTok enables users to inscribe short messages (up to 80 bytes) onto the Bitcoin blockchain, creating a permanent digital record. In the future, ChainTok will offer custom physical keepsakes (e.g., plush charms) linked to these inscriptions via unique on-chain hashes. The Services are provided on an “as is” and “as available” basis, subject to these Terms.

2. Eligibility​

2.1 Age Requirement​

You must be at least 13 years old (or the minimum legal age in your jurisdiction to form a binding contract) to use the Services. If you are under 18, you must have your parent or legal guardian’s consent to use the Services, and they must agree to these Terms on your behalf.

2.2 On Behalf of an Organization​

If you use the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and “you” refers to both you and the organization.

3. Account and Registration​

3.1 Account Creation​

To use the Services, you may need to create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Security Notification​

You must notify ChainTok immediately of any unauthorized use or security breach at [email protected].

3.3 Account Suspension or Termination​

ChainTok reserves the right to suspend or terminate accounts with inaccurate, fraudulent, or unlawful activity.

4. Using the Services​

4.1 Message Inscription​

You may submit messages (up to 80 bytes, approximately 80 English or 26 Chinese characters) for inscription on the Bitcoin blockchain. You are solely responsible for the content of your messages.

4.2 Content Restrictions​

You agree not to submit messages that:

  • Are unlawful, defamatory, obscene, threatening, harassing, or otherwise violate any laws or ChainTok’s policies.
  • Infringe on intellectual property rights, privacy rights, or third-party rights.
  • Contain malicious code, spam, or solicitations.

4.3 Blockchain Inscription​

Once inscribed, messages are permanent and cannot be altered or deleted due to the immutable nature of the Bitcoin blockchain. ChainTok is not responsible for the content or consequences of your inscribed messages.

4.4 Upcoming Keepsake Feature​

When available, physical keepsakes will be subject to additional terms, including shipping and customization policies, provided at the time of order.

4.5 Fees​

You agree to pay all applicable service fees (excluding Bitcoin network miner fees, which are disclosed separately) as outlined during the inscription process. Fees are non-refundable except as required by law.

5. Intellectual Property​

5.1 ChainTok Content​

All text, images, logos, and other content on the Services (“ChainTok Content”) are owned by ChainTok or its licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reproduce ChainTok Content without prior written permission.

5.2 User Content​

By submitting a message for inscription, you grant ChainTok a worldwide, non-exclusive, royalty-free license to process, store, and inscribe your message on the Bitcoin blockchain and to use it in connection with the Services (e.g., for verification or keepsake creation). You retain ownership of your message content.

5.3 Public Nature of Blockchain​

You acknowledge that inscribed messages are publicly viewable on the Bitcoin blockchain and may be accessed by third parties. Do not submit sensitive or private information.

6. Privacy​

Your use of the Services is subject to ChainTok’s Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to such processing in accordance with the Privacy Policy.

7. Disclaimers​

7.1 Service Availability​

ChainTok does not guarantee that the Services will be uninterrupted, secure, error-free, or free from viruses or other harmful components. The Services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Blockchain Risks​

ChainTok is not responsible for delays, errors, or failures in Bitcoin network confirmations, including miner fee fluctuations or network congestion. You assume all risks associated with blockchain technology.

7.3 Third-Party Services​

The Services may include links to third-party sites (e.g., blockchain explorers). ChainTok is not responsible for the content or reliability of such sites.

8. Limitation of Liability​

To the maximum extent permitted by law, ChainTok and its affiliates, operators, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Services, even if advised of the possibility of such damages. ChainTok’s total liability shall not exceed the fees paid by you for the specific inscription causing the claim.

9. Indemnification​

You agree to indemnify, defend, and hold harmless ChainTok and its operators from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your message content, or your violation of these Terms or applicable laws.

10. Termination​

10.1 By You​

You may stop using the Services at any time. No refunds will be provided for completed inscriptions.

10.2 By ChainTok​

We may suspend or terminate your account or access to the Services for violations of these Terms, unlawful activity, or at our sole discretion with or without notice.

10.3 Effect of Termination​

Upon termination, your right to use the Services ceases, but inscribed messages remain on the Bitcoin blockchain.

11. Modifications to Terms​

ChainTok may update these Terms at any time by posting the revised version on the Services. Continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you do not agree, you must discontinue using the Services.

12. Miscellaneous​

12.1 Entire Agreement​

These Terms, together with the Privacy Policy and any additional terms provided (e.g., for keepsakes), constitute the entire agreement between you and ChainTok.

12.2 Severability​

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

12.3 No Waiver​

ChainTok’s failure to enforce any right or provision does not waive that right or provision.

12.4 Assignment​

You may not assign these Terms without ChainTok’s prior written consent. ChainTok may assign these Terms at its discretion.

12.5 Force Majeure​

ChainTok is not liable for delays or failures due to events beyond its reasonable control (e.g., network outages, natural disasters).
